Legal matters around a home rarely consist of one document or one appointment. Often several parties are involved: a Spanish notary, a notary in the country where you live, a lawyer, a tax adviser, the town hall, a registry or a bank. Language differences, deadlines and missing documents can make the process complicated.

Inheritances and estates

Gifting a home

Gifting a home takes careful preparation. Not only the transfer of ownership, but also the tax consequences, family relationships and practical execution need to be clear in advance.

We map out the situation and coordinate the process with the notary and tax adviser. If those involved cannot travel to Spain, we explore whether the gift can be prepared and completed through a power of attorney.

A will for Spanish property

If you own a home in Spain, it can be wise to have someone assess how your property would be settled upon death. A specialist can explain the options and whether a Spanish will makes sense in your situation.

Powers of attorney

Unable to be present in person for a purchase, sale, gift, inheritance or other notarial matter? Then a power of attorney can be the answer.

We coordinate with the notary involved on which powers are needed and help with the practical preparation. If the power of attorney is signed outside Spain, we make sure it is clear which formal requirements the document has to meet.

A power of attorney is always tailored to its specific purpose. Only the powers needed for the process are included.

Changes in ownership

Sometimes the legal ownership of a home needs to be adjusted.

For example, when:

  • a co-owner is added or removed
  • a home is divided after a divorce
  • family members become joint owners
  • a share in the home is transferred
  • the details in the ownership documents are no longer correct

Together with the specialist involved, we map out which steps, documents and taxes come with the change.

Notarial guidance

A notarial matter in Spain often requires preparation before the appointment can even be made.

We help gather and check the necessary information, coordinate with the notary and make sure everyone involved knows what they need to provide or sign. When an interpreter, a translation, a power of attorney or an additional specialist is needed, we arrange it as part of the process.

Legal review of property documents

Even as an existing owner, you may need to have documents around your home reviewed again.

For example, in the case of:

  • uncertainties in the property register
  • differences between the actual and the registered situation
  • missing permits
  • renovations that may not have been registered correctly

What do we need to get started?

That varies per situation. It often helps if you already have:

  • identity documents of the people involved
  • NIE numbers, if available
  • the title deed of the property
  • Nota Simple
  • details of the notaries or advisers involved
  • the will, death certificate or family details in the case of an estate
  • existing powers of attorney or agreements
  • relevant correspondence
  • a short description of the desired outcome

If a document is missing, that does not mean we cannot start. During the intake we determine what needs to be requested first.
